7Insurance

  1. 7.1The Operator undertakes to effect and maintain at its own expense in respect of the Aircraft:-
  1. (i)Hull all risks and war risks insurance; and
  2. (ii)Aviation third party legal liability insurance
  • Aircraft up to 1 metric tonne – a minimum of £1.5 million
  • Aircraft up to 2.7 metric tonnes – a minimum of £2.25 million
  • Aircraft up to 6.6 metric tonnes – a minimum of £5 million
  1. 7.2The Operator shall procure that the insurance referred to in 7.1(i) above contains a provision waiving any and all rights of subrogation against the Company.
  2. 7.3The Operator shall further procure that the insurance referred to in 7.1 (ii) above:-
  1. 7.3.1includes as an additional insured the Company, its employees, servants and agents: and
  2. 7.3.2contains a provision which provides that such insurance shall operate in all respects (save only for the limit of liability) as if a separate policy had been issued to each insured thereunder; and
  3. 7.3.3is primary without right of contribution from any other insurance available to the Company.
  1. 7.4In respect of any vehicle which the Operator, his servants, agents, or associates may use or operate on that part of the aerodrome which is or has been designated as "airside", the Operator shall at all times ensure that the vehicle is fully and properly insured for third party risks for an appropriate amount having regard to the nature of the risks.
  2. 7.5The Operator shall procure in respect of both insurances that each provides that the Company shall be given 30 days (or such lesser period as may be available in respect of war risks, etc) prior written notice of any adversely material alteration or cancellation of any such insurance.
  3. 7.6The Operator shall provide on demand to the Company Certificates of Insurance or such other evidence reasonably satisfactory to the Company that the insurances are and shall continue in full force and effect.
  4. 7.7The Operator shall at all times fully indemnify and keep indemnified the Company against any breach of this Clause 7 but without prejudice to any other rights of the Company under these Terms and Conditions whether the same shall be enforced by the Company or not.
